同性婚を認めないのは「違憲」 損害賠償は棄却 名古屋地裁 全国2例目
愛知県に住む30代の男性カップルは、同性婚が認められていないのは憲法が保障する「婚姻の自由」や「法の下の平等」に反するとして、国に損害賠償を求める訴えを起こしていました。
30日の判決で名古屋地裁は、同性カップルの関係を国の制度として認めることなく、保護の枠組みもないのは『違憲』との判断を示しました。損害賠償については、訴えを退けました。
同性婚を認めないのは『違憲』とする判断は、2件目です。
